Australia

In Australia, compensation programs for victims of violent crime are state- or territory-based. Each of Australia’s six states and one territory administers its own program in accordance with its own statutes. This overview provides information generally applicable to each program within the country. For information on a specific program, contact the program directly. Contact information for each program is provided below.

Eligibility Requirements

Report to police. Yes; some exceptions may be made for cause.

Filing period. Time limits vary across programs; 2 to 3 years from the date of the crime is typical.

Foreign citizen eligibility. Citizens of foreign countries are eligible to apply for compensation in the state or territory where the crime occurred.

Claimants

Victims of violent crime
   
Dependents of homicide victims
   
Family members of victims of violent crime (limited to specific programs)

Procedures

Application forms are available from each program. Victims of crimes that occurred in Tasmania should contact the victim assistance unit for help in completing the Director of Public Prosecutions (DPP) clearance form if necessary.

Benefits and Award Limits

The programs provide some compensation according to a schedule of injuries that specifies the compensation amount for a particular injury. Most states can pay a maximum combined award between $A15,000 and $A60,000. The maximum compensation paid in Western Australia is between $A15,000 and $A50,000 depending on the date of the offense.

Emergency awards. Some programs provide emergency awards or expedite processing for victims faced with extraordinary financial hardship.

Funding sources. Compensation programs in Australia are funded with consolidated revenue.
